Senators Dave McCormick & John Fetterman Support Common Sense Solution to Require Gluten Labeling to Protect Americans with Celiac Disease

We are grateful to Senator Dave McCormick and Senator John Fetterman who have supported Jax's common sense solution to require the labeling of Gluten as a Major Food Allergen in the United States. This is an example of bipartisanship on an issue that is actionable and not controversial to Make America Healthy Again.
"Dear Commissioner Makary and Secretary Kennedy: I write to ask you to give your full and fair consideration to using your existing authority to require the labeling of gluten as a 'Major Food Allergen.'... Under the Food Allergen Labeling and Consumer Protection Act of 2004 (FALCPA), the FDA is not precluded from requiring the labeling of gluten as a 'Major Food Allergen.' Notably, 87 countries including Canada, Mexico, Australia, and much of the EU already require gluten labeling on packaged foods. I respectfully urge your agency to give full consideration to using this authority to improve the lives of individuals with Celiac disease."-- Senator Dave McCormick
On 8/22/25, Senator McCormick wrote to HHS Secretary Robert F. Kennedy, Jr. and FDA Commissioner Marty Makary to ask them to use their existing statutory authority to issue rulemaking to require the labeling of Gluten on all packaged foods in the U.S., just like Gluten must be declared on all food labels in 87 other countries.
Make Our Children Healthy Again Strategy Report
On 9/9/25, Celiac Journey applauded the release of the Make Our Children Healthy Again Strategy Report which details policy reforms that will make a meaningful difference in the lives of 3.3 million Americans with Celiac Disease, including about 729,000 children like Jax, the MAHA Kid. The MAHA Strategy Report includes language on Celiac Disease and requiring the labeling of Gluten as a food allergen:
"Food Allergies: FDA will develop guidance on diagnostics and treatments for food allergies. FDA will also make recommendations about requiring transparency in disclosures of ingredients that impact certain health conditions, such as gluten for those with Celiac disease, and other established food allergens."
The MAHA Strategy Report recognizes that it's time for FDA to address this critical consumer protection food safety issue with the urgency it requires and issue rulemaking requiring the labeling of Gluten as a "Major Food Allergen" based on the Secretary Kennedy's existing statutory authority under the Food Allergen Labeling and Consumer Protection Act of 2004.
Jax Has Been Making His Case to the United States Senate
Jax has made his case to various United States Senators, including Senator Rick Scott from Florida who is Gluten Free like Jax. Senator Scott shared how challenging it can be to eat a Gluten Free diet for medical reasons and not know what products may have Gluten containing ingredients.
After meeting with Jax in his office, Senator Scott asked Jax to walk with him to the floor of the Senate since he had to go cast a vote. Senator Scott is a fast walker! Senator Scott took Jax in the "Senator's Only" elevator and also on the Senate Subway. Along their journey, Senator Scott stopped Senator Elizabeth Warren, introduced Jax, gave Jax's pitch to her on requiring the labeling of Gluten and asked Senator Warren to help support Jax's common sense and bipartisan solution.
Senator Scott said something to Senator Warren to the effect of "we do not agree on much, but I hope we can agree on this." Later than day, Jax was in Senator McCormick's office and ran into Senator Warren again who smiled and said "oh, it's you again Jax." Jax smiled back, gave his elevator pitch to her again, and showed her how just one crumb of Gluten is like kryptonite to him.
